General Terms and Conditions
Wi-Fi / Internet Terms of Use
The operator merely acts as an access provider. There is no legal claim to the (uninterrupted) use and/or a specific speed of the internet access. Due to technical circumstances, uninterrupted operation cannot be guaranteed. The operator does not offer unlimited availability of internet access or server accessibility and does not guarantee the error-free transmission or forwarding of data traffic.
Data transmission is unencrypted. The transmitted data may therefore be viewed or altered by third parties. The operator is not responsible for securing data traffic.
The user expressly acknowledges that the provided LAN / WLAN only enables internet access but does not include any virus protection or firewall.
User Obligations
The user is solely responsible for the data transmitted via the guest Wi-Fi, for paid services used and legal transactions conducted via it.
The user is obliged to comply with applicable law when using the LAN / WLAN. The user is prohibited from misusing or allowing the misuse of the access to the provided LAN / WLAN.
Specifically prohibited are:
- the commercial use of the LAN / WLAN access;
- the retrieval or dissemination of immoral or illegal content (especially pornographic, glorifying violence, or inciting hatred);
- the unlawful reproduction, distribution, or making accessible of copyrighted material;
- disregarding applicable data protection regulations;
- the sending or dissemination of harassing, defamatory, or threatening content, as well as inciting or calling for criminal acts;
- the use of the service by third parties; in particular, the paid transfer of these services to third parties requires the express, written consent of the operator.
- the use of the provided LAN / WLAN for sending mass information (spam) and/or other forms of unauthorized advertising;
- visiting file-sharing websites, in particular, initiating music and/or film downloads.
- the disclosure of passwords and access information. The user is obliged to keep their passwords confidential. They are liable for damages resulting from insufficient password confidentiality.
- The user undertakes to ensure the proper configuration of the terminal device identification.
- The user assumes responsibility for ensuring that the terminal device used by them and the software on it are free of viruses and other malicious programs; the user must fully compensate the operator for any direct or indirect damages caused by a breach of this obligation.
- Any occurring disturbances must be reported to the operator immediately.
Violations of the Terms of Use
In the event of a violation of the terms of use or suspicion of a violation, the use of the provided LAN / WLAN may be blocked at any time and without stating reasons.
Should the operator be exposed to third-party claims for any reason due to the user’s use of the Guest LAN / WLAN, the user is obliged to indemnify and hold the operator harmless in this regard.
Not included are the costs of using transmission facilities up to the selected Point of Presence, nor are the costs that may be charged by third parties for the use of services.
Data Recording
Liability
The operator is liable for personal injury and property damage for which they are responsible only insofar as legal provisions mandatorily provide for liability that cannot be contractually excluded (e.g., for intent and gross negligence). Otherwise, any liability, especially for data, hardware, and software, is excluded.
The operator is not liable for the content of transmitted data, or for the content of data accessible through use, even if access is provided via a link from the operator’s homepage or start page(s).
